Rwanda – Our Client/ Opponent has registered the mark Star Logo in Classes 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45 and renewed on 28 July 2020

On 8 July 2021, we have filed an opposition against a conflicting mark AHUVAN Logo in class 30 as it has been published in Official Gazette No. 4 of 2021, page 18.

The grounds of opposition are the following:

Ø The applicant mark is not distinctive according to article 134 (1) of Rwanda IP Law.
Ø The applicant mark is an imitative according to article 134 (2) of Rwanda IP Law.
Ø The applicant mark is confusing similar according to article 134(3) of Rwanda IP Law.

The examiner has requested the applicant to submit the counterstatements against the opposition within 14 days, the applicant did not file any response.

The Rwanda IP Office, has accepted our request and has refused the applicant’s trade mark AHUVAN Logo in class 30 in the name of Kentath Ltd
